Project Valo Rakha: Terms and Accountability Agreement
This document (the "Agreement") governs the operation of the self-funded initiative Project Valo Rakha (the "Project," "We," or "Us") and defines the responsibilities of the founder and all applicants/recipients (the "User"). By accessing our website or submitting an application, the User agrees to these terms.
1.1. Non-Charitable Status: Project Valo Rakha is a self-funded, personal social enterprise initiated and managed solely by the founder, Sadik Abdullah. The Project is NOT a legally registered charity, NGO, or non-profit organization in the UK, Bangladesh, or any other jurisdiction.
1.2. Funding Source: All grants disbursed are sourced exclusively from the founder's personal savings and earnings. We do not solicit, accept, or process donations from the general public at this time. Any future change to this status will require a full public update to this Agreement.
1.3. Grant Nature: All disbursements are provided as personal gifts (Hibah). They are not investments, loans, or contractual payments.
1.4. Limitation of Liability: The founder acts only as an intermediary to arrange the transfer of funds through a local partner. The Project, the founder, and the local partner assume no personal, legal, or financial liability for any event, damage, injury, or loss that may occur to the recipient, institution, or their property before, during, or after the disbursement of the grant.
2.1. Non-Guaranteed Funding: Submitting an application is an expression of need but does not guarantee funding. The founder retains the sole and absolute discretion to select recipients based on the assessment of verifiable, urgent need and the availability of personal funds.
2.2. Verification of Need: All selected applicants must agree to a verification process conducted by our local partner. This may involve phone calls or document review. Failure to cooperate fully will result in the immediate cancellation of the grant offer.
2.3. Funds Disbursement: Funds will be transferred solely through Mobile Financial Services (MFS) such as bKash, Nagad and more. The Project is not responsible for MFS system errors, transfer delays, or fees imposed by the MFS provider or any intermediary bank.
2.4. Liability Ends Upon Transfer: The Project's financial responsibility for a grant ends immediately upon the successful confirmation (MFS Transaction ID) that the BDT amount has been credited to the recipient's MFS account.
2.5. Anti-Scam and Security Warning (Crucial): The Project Valo Rakha team will never, under any circumstances, request money, fees, passwords, or personal financial details (such as account PINs or credit card numbers) from any applicant or recipient at any time. Be highly vigilant of scammers using our project name. We manage our audit process through our local partner, who will only confirm your bKash/Nagad MFS number for the transfer and request non-identifying proof of purchase; they will not ask you for anything else. If anyone claiming to be from our project asks for payment or sensitive personal security information, you must immediately terminate the communication and report the incident to our official contact email.
3.1. Recipient Dignity and Anonymity (Sacred Trust): We are guided by the principle that donation should be done in private. The Project guarantees that the recipient’s full name, photo, passport/NID, contact details, and precise location will NEVER be made public on the website or any social media channel without explicit, separate written consent.
3.2. Mandatory Consent for Audit: To maintain the high level of accountability necessary for future partnership, the applicant must agree to the following terms, which are documented in our Private Ledger:
Audit Consent: Permission for the Project to securely store the MFS Transaction ID for the grant. This record is strictly for private audit purposes only.
Proof of Impact: Permission for our local partner to obtain a non-identifying photo or video of the purchased items (e.g., food, medicine, blankets) to confirm the funds were used for the stated purpose. This auditable record is essential for demonstrating the Project's integrity to future collaborators and large donors. Faces, identities, and identifying markings of individuals will be concealed.
3.3. Failure of Consent: Any application that fails to confirm agreement to our full T&C and the Triple Proof Standard (as outlined in the application form) will be immediately discarded.
4.1. Non-Professional Advice and Services: The content published in the Awareness & Advocacy Hub (including articles on social issues, crime, and financial tips) is based on the founder's general research and opinion. The Project does not operate as a social work, legal, or counseling service. This content does not constitute professional legal, medical, or financial advice. Users must consult official, licensed professionals for assistance with legal or personal matters.
4.2. No Liability for Advice: The Project, the founder, and the local partner assume no liability for any actions taken or decisions made based on information presented on this website.
5.1. Termination of Grant: The founder reserves the absolute right to discontinue the Project or terminate any grant offer at any time, for any reason, without prior notice.
5.2. Governing Law: This Agreement is created under the law of England and Wales (United Kingdom), reflecting the founder's legal location. Any disputes will be subject to the jurisdiction of the courts of England and Wales.
